                   AN ORDINANCE TO AMEND ORDINANCE NO. 9153,
                   ENCAPTIONED AS SET FORTH HEREIN, SO AS TO
                   REMOVE CONDITIONS SET FORTH THEREIN.

              	   WHEREAS, on April 18, 1989, the City Council of the 
City
         of Chattanooga, Tennessee, enacted Ordinance No. 9153 
encaptioned,
         "AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, KNOWN AS 

         THE ZONING ORDINANCE, SO AS TO REZONE A TRACT OF LAND LOCATED 
AT
         7643 EAST BRAINERD ROAD, BEING ON THE NORTHEAST LINE OF EAST
         BRAINERD ROAD SOUTHEAST OF MEADOW LARK LANE FROM R-1 
RESIDENTIAL
         ZONE AND R-2 RESIDENTIAL ZONE TO C-2 CONVENIENCE COMMERCIAL
         DISTRICT, SUBJECT TO CERTAIN CONDITIONS";
                                  NOW, THEREFORE,
              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 9153, 
attached
         hereto and incorporated herewith, be and the same is hereby
         amended so as to delete Section 2 in its entirety and 
substitute
         in lieu thereof the following:
              	   "SECTION 2.  BE IT FURTHER ORDAINED, That this
              rezoning shall be subject to the following conditions:

                1.  Subject to dedication of right-of-way as
                    required by the Traffic Engineer.
               
                2.  The areas reserved for utility easements must
                    be kept free and clear of all structures.
               
                3.  All other existing easements are retained."
               
               
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage as 
provided
         by law.
